Terms of Service

1. Parties and Acceptance

These Terms of Service ("Agreement") constitute a legally binding agreement between you ("Subscriber", "Inspector", or "Agency") and BuyIQ Pty Ltd ("FastAccept", "we", "us", or "our"), governing your access to and use of the FastAccept strata inspection auto-claiming software, browser extension, cloud queuing routers, and workbench applications.

By registering for an account, entering credentials, connecting Stripe billing, or installing the FastAccept Chrome extension, you affirm that you are at least 18 years old, authorized to bind your inspection agency, and agree to be bound by this Agreement.

2. Scope of Service & Third-Party Portals

FastAccept provides high-performance workflow automation tools designed to assist licensed Australian strata and building inspectors in:

  • Monitoring inspection opportunity feeds and notifications in real time.
  • Executing automated claims on third-party platforms (including BeforeYouBuy) pursuant to your pre-configured territory zones and job caps.
  • Assisting with Letters of Authority (LOA) generation and strata management search bookings.
  • Assisted autofill of strata search submission forms via the FastAccept client-side extension.

You acknowledge and agree that FastAccept is an independent software tool and is not affiliated with, endorsed by, or sponsored by BeforeYouBuy Pty Ltd or any third-party strata management portal. You remain exclusively responsible for ensuring that your automated workflows comply with the terms of service of any third-party portal you interact with.

3. Credential Vaulting & Security Obligations

To execute automated claims on your behalf, FastAccept requires your third-party portal session tokens or credentials. We maintain strict cryptographic safeguards:

  • AES-256-GCM Encryption: All sensitive credentials and tokens are encrypted at rest using industry-standard authenticated symmetric cipher suites with rotating keys.
  • Isolation: Each subscriber's vault tokens are partitioned via tenant-level isolation and strict database Row Level Security (RLS).
  • Zero Plaintext Logging: Unencrypted credentials are never logged, never transmitted to analytics providers, and never shared with other tenants.

You are solely responsible for maintaining the security of your FastAccept login credentials and for all activities that occur under your account.

4. Fees, Billing & Australian GST

FastAccept is offered on recurring subscription tiers ($149 Starter, $299 Pro, $499 Agency Master AUD per month).

  • Currency & GST: All fees are stated and charged in Australian Dollars (AUD) and are subject to 10% Australian Goods and Services Tax (GST).
  • Tax Invoices: Automated Australian Tax Invoices are issued through Xero accounting upon successful Stripe subscription settlement.
  • 24-Hour Trial: If enrolled in a 24-hour Pro trial, access terminates automatically after 24 hours unless a paid subscription tier is activated.
  • Cancellation: You may cancel your subscription at any time via the Stripe Customer Portal. Access continues until the end of the current paid billing cycle.

5. Limitation of Liability & Warranties

To the maximum extent permitted by applicable Australian law (including the Competition and Consumer Act 2010 (Cth)):

FastAccept is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the software will be uninterrupted, error-free, or that any specific quota of strata inspection jobs will be successfully claimed.

In no event shall BuyIQ Pty Ltd, its directors, or affiliates be liable for any indirect, incidental, consequential, special, or punitive damages, or loss of profits, contracts, or inspection fees arising out of third-party portal outages, API changes, account suspensions, or network latency. Our total aggregate liability under this Agreement is strictly limited to the total fees paid by you to FastAccept during the three (3) months immediately preceding the event giving rise to liability.

6. Governing Law & Dispute Resolution

This Agreement is governed by and construed in accordance with the laws in force in the State of New South Wales, Australia. Each party irrevocably submits to the non-exclusive jurisdiction of the courts exercising jurisdiction in New South Wales.
